Acceptance of Terms
By accessing and using Cloud Event Manager (“the Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Cloud Event Manager is provided by Host Merchant Services (“HMS”, “we”, “us”, or “our”). Use of the Service is subject to your ongoing merchant account with Host Merchant Services.
Description of Service
Cloud Event Manager is event management software provided at no additional cost to active Host Merchant Services payment processing clients. The Service includes but is not limited to: lead management, event calendar, proposal and contract generation, BEO creation, payment processing integration, guest portal, reporting, and AI-powered features.
User Accounts
To use Cloud Event Manager, you must maintain an active merchant account with Host Merchant Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Acceptable Use
You agree to use Cloud Event Manager only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Host Merchant Services and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Termination
We may terminate or suspend your access to Cloud Event Manager immediately, without prior notice or liability, if your Host Merchant Services merchant account is terminated or suspended, or if you breach these Terms.
Limitation of Liability
In no event shall Host Merchant Services, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
